Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and OptionsHub ("we," "us," or "our"), governing your access to and use of the website, dashboard, and any related applications (the "Service"). By creating an account, checking the acceptance box, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Relationship with KHIA AI

OptionsHub is an independent application. It was built and is technically maintained by KHIA AI, a software development and AI consultancy, acting solely as a third-party technical/software provider. KHIA AI is not the operator of the Service, is not a party to these Terms, has no contractual relationship with you as a user, and bears no liability to you arising from your use of the Service. All obligations, warranties, and liabilities regarding the Service are solely ours.

2. Description of the Service

OptionsHub is a self-directed trade journaling, portfolio analytics, and options screening tool. It lets you log and track your own options trades, view analytics derived from data you enter, receive third-party market data quotes, and receive AI-generated summaries, insights, and screening results ("AI Outputs"). OptionsHub does not execute trades, hold funds or securities, act as a broker-dealer or custodian, or connect directly to your brokerage account. You remain solely responsible for placing, managing, and closing any trades through your own broker.

3. Eligibility

The Service is offered exclusively to residents of the Republic of the Union of Myanmar. By using the Service, you represent that you are a resident of Myanmar and at least 18 years old (or the age of majority under Myanmar law) and legally capable of entering into a binding contract. We do not offer the Service to users outside Myanmar and may restrict or terminate access for anyone found to be accessing it from outside Myanmar or misrepresenting their residency.

4. Not Financial, Investment, Legal, or Tax Advice

We are a software and technology provider only. We are not a broker-dealer, futures commission merchant, investment adviser, financial planner, or fiduciary of any kind, and are not registered as such with any securities or derivatives regulator. Nothing in the Service — including analytics, screens, watchlists, AI Outputs, or educational content — constitutes investment, legal, or tax advice, or a recommendation or solicitation to buy, sell, or hold any security, option, or other financial instrument. No fiduciary or advisory relationship is created between you and us by your use of the Service. You should consult a licensed financial, legal, or tax professional before making trading or investment decisions.

5. Trading Risk Disclosure

Options trading involves substantial risk of loss and is not suitable for every investor. You can lose all, or more than all, of the capital allocated to an options position. Past performance — whether your own historical trades, a strategy backtest, or figures shown in the Service — is not indicative of future results. You are solely responsible for evaluating the risk of any trade and for all trading and investment decisions you make, whether or not informed by the Service.

6. AI-Generated Content

Certain features (including Insights, Discovery, and similar screens) use third-party AI models to generate summaries, commentary, or screening results based on market data and/or the trade data you provide. AI Outputs are generated automatically, are not reviewed or verified by us before being shown to you, and may be incomplete, outdated, or factually wrong ("hallucinated"). AI Outputs are provided for informational and educational purposes only and must not be relied upon as the basis for a trading or investment decision without independent verification.

7. Market Data

Quotes, prices, and other market data displayed in the Service are sourced from third-party data providers and may be delayed, incomplete, or inaccurate. Market data is provided for informational purposes only and should not be used as the sole basis for a time-sensitive trading decision. Always confirm prices and positions with your broker or an official market source before acting.

8. Accounts

You must provide accurate registration information and keep it current. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials. Notify us promptly of any unauthorized use of your account. Accounts are personal to you; you may not share credentials or allow another person to use your account.

9. Subscriptions, Billing & Cancellation

  • The Service offers a free tier with usage limits (including a monthly trade-logging cap) and paid "Pro" subscription plans billed monthly, quarterly, or annually.
  • Paid subscriptions are billed in advance through our payment processor and automatically renew at the end of each billing period unless cancelled before renewal.
  • You can cancel at any time from your account settings; cancellation takes effect at the end of the then-current billing period, and you retain paid access until that date.
  • Fees are non-refundable except where required by applicable law, or at our sole discretion.
  • We may change subscription pricing on a going-forward basis with reasonable advance notice (e.g., in-app notice or email); continued use after a price change takes effect constitutes acceptance of the new price at your next renewal.
  • We do not store your full payment card details; payment data is handled directly by our payment processor under its own terms and privacy policy.

10. Your Data & Content

You own the trade data, notes, and other content you enter into the Service ("Your Data"). You grant us a limited, non-exclusive license to host, store, process, and display Your Data solely to provide, maintain, and improve the Service, including generating the analytics and AI Outputs you request. You can export Your Data as a CSV file at any time from Settings, and permanently delete Your Data by deleting your account. See our Privacy Policy for details on how we handle your data.

11. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose, or in violation of any exchange, broker, or data-provider terms that apply to the underlying market data;
  • Reverse engineer, scrape, or attempt to extract the Service's underlying models, source code, or market/AI data at scale for redistribution or resale;
  • Circumvent usage limits, subscription tiers, or credit caps, or interfere with the security or proper functioning of the Service;
  • Use the Service to provide investment advice or portfolio management services to third parties without your own appropriate licensing and a separate agreement with us; or
  • Upload unlawful content or content that infringes another person's rights.

12. Intellectual Property

The Service, including its software, design, branding, and (excluding Your Data and third-party market data) all analytics methodologies and content generated by the platform itself, is owned by us or our licensors (including KHIA AI as our technical developer) and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial trading and journaling purposes.

13. Third-Party Services

The Service relies on third-party providers, including our technical developer (KHIA AI), cloud hosting and authentication infrastructure, payment processing, market data, and AI inference providers. We select these providers carefully but do not control and are not responsible for their availability, accuracy, or acts or omissions. Outages or errors originating from a third-party provider may affect the Service and are outside our control.

14. Suspension & Termination

You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you breach these Terms, misuse the Service, fail to pay applicable fees, or if required by law. Upon termination, your right to use the Service ends immediately; Sections 4–7 and 17–19 survive termination.

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service and all content, data, and AI Outputs are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, timely, or error-free, or that any data, analytics, or AI Output will be accurate or reliable.

16. Limitation of Liability

To the maximum extent permitted by applicable law: (a) in no event will we, our officers, employees, or contractors (including KHIA AI) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading or investment losses of any kind, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages; and (b) our total aggregate liability arising out of or relating to these Terms or the Service, for any cause whatsoever, will not exceed the total amount you paid us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.

These limitations apply regardless of the legal theory of liability (contract, tort, negligence, strict liability, or otherwise) and are a fundamental basis of the bargain between you and us. Where applicable law does not allow the exclusion or limitation of certain damages, or limitations on liability for gross negligence, willful misconduct, fraud, or death or personal injury, some or all of the above exclusions may not apply to you, and our liability will be limited to the smallest extent permitted by law.

17. Indemnification

You agree to indemnify and hold harmless us, our officers, employees, and contractors (including KHIA AI) from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of: (a) your use of the Service; (b) any trading or investment decision you make; (c) Your Data; or (d) your violation of these Terms or applicable law.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of the Union of Myanmar. Any dispute not resolved through good-faith informal negotiation will be submitted to the competent courts of Myanmar.

19. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by a new "Last updated" date and, where required, a fresh acceptance prompt within the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

20. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a right is not a waiver of that right.
